Terms of Service

PLEASE READ THIS AGREEMENT CAREFULLY BEFORE JOINING OR VIEWING OUR COMMUNITY.

By accessing our web community (guysplayinhard.com), hereinafter referred to as the "Service" you signify your assent to our User Agreement Terms of Use including all amendments made to date. If you do not agree to these terms you may not access or use the Service.

Privacy, yours and ours, is very important to the Service. We do not share or sell your information to any third parties. Our efforts are intended to foster a community of like minded men. For your protection, your direct contact information is never made available to other members. As issues related to privacy arise we will update our policies and practices for your benefit.

Your email address will be used only for messages related to the Service. Whenever possible and practical we will communicate with you through the email address you registered with. When replying to inquiries you send us by email we will respond in kind. By default you will receive emailed notifications of new messages you have received on the service. You may disable these message notifications at your discretion.

This community is intended to be a safe and welcoming environment for men over the age of 18, races, religions and nationalities. To that end we have developed the following:

TERMS AND CONDITIONS OF USE

1. User Agreement. This Agreement constitutes your agreement with GuysPlayinHard Internet Partners, Inc. with respect to your use of the Service. You must agree to and abide by all of the terms and conditions contained in this Agreement in order to be an authorized user of the Service. As used in this Agreement, "we" and "us" refers to GuysPlayinHard Internet Partners, Inc., or any successor or assign of GuysPlayinHard Internet Partners, Inc.

Your right to use the Service is subject to any limitations, conditions and restrictions established by us at any time, in our sole discretion. Access may be altered, suspended or discontinued at any time including specific features, database or content access. We may place limits or restrictions on access to specific features of the Service without notice or liability.

2. Minimum Age. The Service is an adults only community. You represent and warrant that your are at least 18 years old, or the age of consent in the Country and State in which you live (whichever is older). We reserve the right to request proof of age or to suspend/delete your profile if in our sole discretion we have determined you may not be representing your true age.

3. Membership Options. Basic membership to the Service is free and includes reasonable access to member profiles and email. Members who wish to support the site's costs can upgrade for modest fees to gain access to premium features. These options may change without notice due to technical issues beyond our control.

4. Members' Code of Conduct. You are joining a community of men who share many interests in common. Not everyone will share all of your opinions and values and you are expected to behave as an adult among adults while logged onto the Service. The following will not be tolerated:

  • - email, upload, link or otherwise distribute any material on the sites that may be offensive, copyrighted or illegal;

  • - diminish another member's use and benefit from the Service;

  • - post multiple profiles except with the express permission of the Services' operators for the purpose of transitioning to a new user name;

  • - use the Service to promote goods or services without making arrangements to do so with the site's operators;

  • - copy, distribute or resell any content from the Services without the written permission of the Service's operators;

  • - access or interfere with the operation of the server, database or other systems that comprise the Service.


We may, without advance notice or justification:

  • - remove or fail to approve material you upload to the Service;

  • - cancel your membership at any time;

  • - discontinue operation of the Service.


5. Password Use. These are adult communities and are intended only for members. On joining you will establish a username and password. It is required that you access the Service only through your username and password. You can not share your username and password with non-members and you are responsible for any actions done under your username and password.

6. Personal Use of the Service. The Service is for personal use only and may not be used by any user for commercial purposes. All material on the Service is copyrighted and may not be used outside of the Service.

7. Your Profile and Uploads. You warrant that all material you upload to your profile on the Service is:

  • - true and accurate, your own property or property that you have the right to upload;

  • - you further agree that your upload is not harmful, offensive, discriminatory to other members;

  • - you will take all measures necessary and practicable to insure that the material you upload is free from virus, worm, trojan or any other malicious code that may cause harm to the site or member computers.


8. Review of Uploads. Every image uploaded is reviewed prior to approval. Any material that in our sole opinion is inappropriate, offensive, or illegal will be refused. Any material that is called to our attention after being approved that we find inappropriate, offensive or illegal will be removed without notice.

9. Service Availability. Every measure is taken to insure the Service is available for you whenever you wish to access it. The Service is optimized for members accessing it with Internet Explorer installed on a computer running Windows XP. We will make efforts to support members with other operating systems and browsers but we will not re-engineer the Service or make the Service less usable for members with appropriate systems to compensate for non-standard, out-of-date or unique computer configurations.

10. Termination of Service Rights. Failure to comply with the Terms and Conditions of the Service will result in the automatic termination of your membership and rights to access the Service.

11. Right to Amend these Terms and Conditions. We reserve the right to amend these terms at any time by posting updated terms to the Service. Your continued use and access of the Service following these changes constitutes your continued acceptance of these modified terms.

Credit card payment information is collected by and processed through our payment processing gateways at Verotel / VTSUP(Verotel.com) and our merchant account GuysPlayinHard Internet Partners.0 Financial information provided is collected via a secure connection through our payment processing services referenced above. GuysPlayinhard does not collect this information and will not authorize the release of the information to anyone not directly involved in processing the transaction. This information may be encrypted and stored for logging purposes Verotel or Authorize.net.

Credit card numbers are used by Verotel Guys Internet only for processing payments and are not used for any other purposes. GuysPlayinHard entered into written agreements with Humboldt and Verotel and will continue to enter into written agreements with third parties that provide credit card processing services.

You also have the option to disclose your ethnicity and your attitude to safer sex, however these are optional fields. The special category data on your profile is visible to every member who views your profile. This data can’t be hidden once you’ve posted it to your profile. You can delete any special category data from your profile at any time.

Your personal data can only be accessed by other members of the sites you belong to. You can control what data is posted and visible on your profile. Pictures can be posted as private and shared only with members you expressly grant access to. GuysPlayinHard restricts access to members only and blocks the copy / capture of images, text and video from the site. We cannot block members from screen captures of the site and your data. You should consider this in determining what you post to your profile.

8. Access to your Personal Data
You control access to Personal Data maintained or stored by you via GuysPlayinHard websites for your profile and account management. You may update your information at any time. You may cancel your account at any time. You can delete your own personal data from your profile at any time. You may also request that your personal information be deleted from GuysPlayingHard already databases, with the exception of: network access logs, which may be stored for any duration of time at GuysPlayinHard discretion, cases where financially fraudulent or otherwise illegal activity is deemed to have occurred (as determined by GuysPlayinHard management or law enforcement officials), in which case personal information may be retained indefinitely for purposes of ongoing investigation and prevention of fraud recurrence, or cases where a violation of the Customer Agreement and applicable Terms of Service has resulted in cancellation of your account (as defined by revocation of your permission to utilize GuysPlayinHard website), in which case personal information may be retained indefinitely for purposes of prevention of further use of Guyservices in the future by the offending individual. Requests to delete your Personal Data will result in your loss of access to GuysPlayinHard websites and you will be blocked from rejoining with the same data.
